2. Services
Aaliana Marketing LLC provides professional marketing and digital business solutions designed to help businesses establish and grow their online presence.
The scope of each Project shall be determined by the applicable proposal, quotation, invoice, service package, or written agreement between the Company and the Client.
Any additional work requested outside the agreed scope may result in additional fees.
3. Payments
Clients agree to pay all fees associated with the selected services.
- Certain Projects require an upfront deposit or full payment before work begins.
- Ongoing services may be billed monthly or according to the agreed payment schedule.
- Invoices are due on the date specified unless otherwise agreed in writing.
- Late payments may result in suspension of services.
- Any outstanding balances must be paid before final deliverables, source files, account credentials, or ownership rights are transferred.
The Client is responsible for all applicable taxes unless otherwise stated.
4. Client Responsibilities
The Client agrees to:
- Provide accurate information.
- Supply all required content, images, branding assets, and project materials.
- Obtain permission for any third-party content provided.
- Respond to requests for feedback and approvals promptly.
- Maintain access to required third-party accounts where applicable.
Project timelines may be extended due to delays caused by the Client.
5. Revisions
Revision allowances vary depending upon the purchased service or written agreement.
Requests outside the agreed scope or after final approval may incur additional charges.
Approval of any deliverable signifies acceptance of that work.
6. Intellectual Property
The Client retains ownership of any original content supplied to the Company.
Upon receipt of full payment, ownership of final deliverables created specifically for the Client shall transfer to the Client unless otherwise agreed in writing.
Until payment has been received in full, all work remains the property of Aaliana Marketing LLC.
The Company reserves the right to display completed work within its portfolio, website, marketing materials, or case studies unless otherwise agreed in writing.
7. Third-Party Platforms
Many of our services involve third-party platforms, including but not limited to:
- Meta (Facebook & Instagram)
- Microsoft Advertising
- Shopify
- WordPress
- Wix
- Squarespace
- GoHighLevel
- HubSpot
- RingCentral
- Twilio
We are not responsible for changes, outages, suspensions, account restrictions, policy changes, pricing changes, or technical issues affecting third-party platforms.
The Client remains responsible for complying with the terms and policies of all third-party services.
8. Marketing Disclaimer
Digital marketing results vary significantly depending on numerous factors beyond our control.
Accordingly, Aaliana Marketing LLC does not guarantee:
- Search engine rankings.
- Website traffic.
- Lead generation.
- Sales.
- Revenue.
- Return on investment (ROI).
- Advertising performance.
- Social media growth.
- Email open rates.
- SMS response rates.
- Business profitability.
Past performance should not be interpreted as a guarantee of future results.
9. Advertising Budgets
Advertising budgets paid to Google, Meta, Microsoft, TikTok, LinkedIn, or any other advertising platform are separate from our management fees.
Advertising costs paid directly to third-party platforms are non-refundable.
The Client remains solely responsible for funding and managing advertising accounts unless otherwise agreed.
10. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information disclosed during the course of the Project.
Confidential information shall not be disclosed except where required by law or with prior written consent.
11. Project Delays and Inactive Projects
Projects requiring Client participation may be placed on hold if required materials, approvals, or communication are not received.
Projects with no written communication for forty-five (45) consecutive days may be considered inactive.
Reactivation fees may apply where substantial work must be resumed after prolonged inactivity.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Aaliana Marketing LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of our website or services.
Our total liability for any claim shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
Nothing in these Terms excludes liability where such exclusion is prohibited by law.
13. Refunds
Refund requests shall be governed exclusively by our Refund Policy.
Clients are encouraged to review the Refund Policy before purchasing any services.
14. Privacy
